How to Obtain a Verified Employment Contract


A verified employment contract is one of the core requirements in the issuance of the
travel clearance or the OEC (Overseas Employment Certificate) by the Department of
Migrant Workers (DMW) for Filipino overseas workers who are travelling from the
Philippines for work.


One way to get a verified employment contract, for those with existing employment
contracts, in mainland China, particularly in Guangdong, Guangxi Zhuang Autonomous
Region, Hainan, and Hunan is to have your employment contract apostilled. For more

Procedures on how to apply for Apostille:


1. Prepare your documents - original and copies of duly stamped and signed
employment contract, passport and IDs of the contracting parties, documents
related to the contracting parties such as business registration/license, etc.


2. Bring all documents to a Chinese Notary Public for notarization and then to
the Foreign Affairs Office (FAO)/Foreign Affairs Service Center (FASC) in your
city/province for apostillisation.


Note that after the FAO’s apostillisation, the document can already be submitted to the
DMW for the issuance of travel clearance or OEC.

For new employment contracts, where the employee is still in the Philippines and is
unable to sign the contract, the legal representative of the company/employer (or legal
representative/employer’s authorized representative) is required to personally appear
and sign the contract with the company’s official stamp at the Philippine Consulate
General (PCG).


For new employment contracts where the employee is already here in China as a
Land-based Name Hire Workers or workers who transferred from another
company, both of the parties (employee and employer) must bring the unsigned
employment contract to the PCG to apply for Acknowledgement.


ACKNOWLEDGMENT is a notarial act by which the Consular Officer of the PCG
acknowledges that a particular person signed a given document. It is often used for
agreements, business documents, etc., and may be used for new employment
contracts.

Following are the requirements:


1. Original unsigned company-prepared employment contract compliant with
DMW's minimum standard requirements. A copy of the DMW Standard
Employment Contract for Various Skills form may be used as reference;


2. Copy of unsigned company-prepared employment contract compliant with
DMW's minimum standard requirements;


3. Copy of company's business license/registration with English translation;


4. Company profile in English language;


5. Copy of worker’s passport, curriculum vitae and job description;


6. Copy of the legal representative/employer's passport or National ID;


7. Original copy of the authorized representative’s Power of Attorney and
Employment Certificate signed by the Legal Representative appearing on the
company's business license/registration on company letterhead and with the
company’s official stamp (if applicable);


8. Copy of the authorized representative’s passport or National ID (if applicable).
At the PCG, pay the appropriate fees and note the Consular Officer's advice on the
day/time when the acknowledged documents will be released.
